This English version is provided for the convenience of non-French-speaking customers. In the event of any discrepancy, ambiguity or contradiction between this English translation and the French version of the General Terms and Conditions of Sale (Conditions Générales de Vente), the French version shall prevail, consistent with the application of French law to these terms.

L'Atelier des J benefits from the VAT-exempt regime ("franchise en base de TVA") under article 293 B of the French General Tax Code. Consequently, VAT is not applicable.

2. Scope and Acceptance of the Terms

These General Terms and Conditions of Sale ("Terms") apply to all orders placed on the website https://l-atelier-des-j.fr and govern the contractual relationship between Jonathan VARELA, operating under the trading name L'Atelier des J, and any customer, whether a consumer or a professional.

Any order placed on the website implies the prior, express and unreserved acceptance of these Terms. The customer acknowledges having read these Terms before placing the order.

Amendment of the Terms: L'Atelier des J reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date the order is validated by the customer.

3. Products

The products offered on the website are accessories for visual identification, equipment carrying or collection, designed to meet the needs of field professionals (law enforcement, security, emergency services), practitioners of sports or historical reconstitution activities, and private collectors.

Nature of the products: The products marketed (MOLLE patches, identification plates, rank plates, equipment supports, miscellaneous accessories) are decorative and functional accessories for identification or carrying purposes. They do not constitute personal protective equipment (PPE) within the meaning of Regulation (EU) 2016/425, are not approved or endorsed by the institutions whose emblems, designations or ranks may be referenced or represented, and may not be used as a substitute for regulation service equipment.

Manufacturing and materials:

  • 3D-printed products are designed and manufactured in our workshop in Charente-Maritime (France), mainly in PETG and TPU for parts requiring high resistance, and in PLA for decorative parts (technical thermoplastic materials).
  • Certain components (e.g. reflective bands, LED lights, fasteners) are not manufactured in France but are selected for their robustness and compatibility with tactical equipment.
  • The customer is informed that the thermoplastic materials used are sensitive to prolonged exposure to temperatures above 70 °C, to direct flame, to certain solvents and, over the long term, to UV radiation. Such exposure may alter the product without such alteration constituting a defect of conformity.

Images and descriptions: Product photographs and descriptions are provided for indicative purposes only. Colours and dimensions may vary slightly due to differences related to the manufacturing process, the materials used and the customer's screen display settings. These minor variations shall not constitute a defect of conformity.

Use and intended purpose of the products: The products sold are intended for use in accordance with their description and with the applicable regulations. The use, possession, wearing and any public display of the products are the sole and entire responsibility of the buyer.

The buyer expressly acknowledges being informed that:

  • the public wearing, by a person not holding the corresponding legitimate capacity, of a uniform, insignia, rank or emblem bearing a resemblance to an official uniform of law enforcement or armed forces such as is likely to cause confusion in the mind of the public, may constitute an offence punishable in particular under articles 433-14 and 433-15 of the French Criminal Code; similar provisions may apply in other jurisdictions;
  • the mere acquisition of a patch, an insignia or a rank plate confers no status, no right to wear it on duty, and no administrative authorisation;
  • certain accessories (holsters, weapon supports, ammunition holders, etc.) may also be subject, in the buyer's country, to specific regulations relating to weapons or intervention equipment.

By validating the order, the buyer undertakes to use the product only within a lawful and legitimate framework (professional duty within an authorised administration, historical or cinematographic reconstitution, supervised sports practice, private collection, decorative use). L'Atelier des J disclaims all liability in the event of non-compliant, unlawful or fraudulent use, or use of a nature likely to cause confusion as to the actual capacity of the user.

4. Prices

Prices displayed on the website are expressed in euros (€) and are stated exclusive of VAT (VAT not applicable under article 293 B of the French General Tax Code).

Prices may be modified at any time by L'Atelier des J. However, products are invoiced on the basis of the rates in force at the time of order validation.

Shipping fees:

  • Mainland France: Shipping fees are calculated according to the carrier chosen (Colissimo or Mondial Relay) and indicated before order validation.
  • International: Additional fees may apply depending on the destination and the carrier selected.

The total amount of the order, including shipping fees, is displayed and validated by the customer before final confirmation of the order.

Sales outside the European Union — duties and taxes: L'Atelier des J ships primarily to mainland France and within the European Union. For any delivery outside the EU, the buyer bears in full the customs duties, import taxes, clearance fees and administrative formalities required by the country of destination, which are added to the displayed price. The buyer is solely responsible for verifying, before ordering, the lawfulness of importing and possessing the ordered products in the country of destination; certain products bearing emblems, designations or ranks of French units may be subject to restrictions there. L'Atelier des J reserves the right to refuse or cancel any order whose destination or product nature reveals a manifest risk of unlawfulness, in which case a full refund shall be issued.

5. Order and Validation Process

Buyer's capacity: Placing an order is reserved for natural persons of legal age (18 years or older) with legal capacity, or for duly constituted legal entities acting through an authorised representative. By validating the order, the buyer expressly declares that they meet these conditions. L'Atelier des J reserves the right to cancel any order for which it appears, on the basis of objective evidence, that the buyer is a minor, in which case a full refund of the amounts paid shall be issued.

The customer may correct any input errors at each stage of the ordering process, before final validation.

Accepted payment methods:

  • Bank card (Visa, Mastercard)
  • PayPal
  • Apple Pay / Google Pay (where available)
  • Local payment solutions adapted to certain countries

Order confirmation: A confirmation email summarising the essential details of the order is sent to the customer after payment validation. The customer is invited to keep this email.

Customer's responsibility: The customer is responsible for verifying their order before validation. L'Atelier des J disclaims all liability in the event of input errors regarding the delivery address or the characteristics of the product ordered.

Product unavailability: In the event of a stock shortage or temporary unavailability after order validation, L'Atelier des J undertakes to inform the customer as soon as possible and to offer:

  • A replacement by an equivalent product
  • A full refund if no alternative suits the customer, processed within 14 days of the customer's request, in accordance with article L216-3 of the French Consumer Code

6. Payment Terms and Security

Payments are fully secured through our payment partners (Stripe, PayPal). The customer's banking data is never stored on our servers.

Cash or cheque payments are not accepted.

The order is validated after confirmation of payment by our payment processor.

7. Retention of Title

L'Atelier des J retains full ownership of the products sold until full payment of the price, including principal and accessories. In the event of non-payment, L'Atelier des J may claim restitution of the products.

8. Delivery and Transfer of Risk

Products are dispatched after payment validation, within a preparation time of 1 to 4 business days.

Estimated delivery times:

  • Mainland France: 2 to 4 business days
  • International: 5 to 10 business days (variable depending on the destination)

These times are given as an indication and run from the dispatch of the parcel. In the event of a delivery delay not exceeding 7 business days beyond the announced time, no compensation or cancellation may be claimed, except in exceptional circumstances.

Carriers: Orders are dispatched via Colissimo or Mondial Relay, according to the customer's choice.

Transfer of risk: In accordance with article L216-4 of the French Consumer Code, the risk of loss or damage to the products is transferred to the customer at the moment when the customer, or a third party designated by them, takes physical possession of the goods.

Liability for lost or damaged parcels: In the event of loss or damage of the parcel during transport, the customer must report it to L'Atelier des J within 7 days following the expected delivery date (or actual delivery date for damaged parcels). L'Atelier des J shall take the matter up with the carrier and offer, as appropriate, a re-shipment of the product or a refund.

Inspection upon receipt: The customer is invited to check the condition of the parcel and the products upon delivery. In the event of a visibly damaged parcel, the customer must lodge precise reservations with the carrier and notify L'Atelier des J within 48 hours, with supporting photographs.

Parcel returned to sender for reasons attributable to the customer: When a parcel is returned to L'Atelier des J for one of the following reasons, attributable to the customer:

  • incorrect, incomplete or outdated address;
  • lack of access to the address or inability to identify the mailbox;
  • unknown recipient at the indicated address;
  • parcel not collected from the relay point or post office by the expiry of the holding period;
  • refusal of the parcel by the recipient without legitimate reason,

the re-shipment costs are entirely borne by the customer. Flat-rate processing fees of 2 € are also applied to cover the handling of the return. The customer may then choose:

  • re-shipment of the parcel to the corrected address, after payment of the new shipping costs and processing fees;
  • cancellation of the order; in this case, the price of the products is refunded, less the 2 € processing fees and the original shipping fees, which remain acquired by L'Atelier des J in respect of the shipment actually carried out.

Legitimate reasons for refusal include in particular: a visibly damaged parcel upon receipt, or a product error visible from the outside. This clause does not apply to the exercise of the right of withdrawal provided for in article 9 below, which must be the subject of an express notification, nor to returns resulting from an error attributable to L'Atelier des J or the carrier.

9. Right of Withdrawal

9.1. Principle

In accordance with articles L221-18 et seq. of the French Consumer Code, the consumer customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to justify any reason or to pay any penalty.

9.2. Exclusions from the right of withdrawal

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • Products made according to the consumer's specifications or clearly personalised (specific colour choice on request, custom dimensions, personalised engraving, etc.)
  • Products that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection

9.3. Exercise of the right

To exercise the right of withdrawal, the customer must notify their decision by email to contact@l-atelier-des-j.fr using the withdrawal form below or any unambiguous declaration.

9.4. Return conditions

The customer must return the product(s) within 14 days following the notification of their withdrawal. To be accepted, the returned product must:

  • Be in its original, intact packaging
  • Show no signs of use, assembly or damage
  • Be accompanied by all accessories and instructions
  • Be returned in protective packaging suitable for transport

Return shipping costs are borne by the customer.

In the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product, L'Atelier des J reserves the right to reduce the refund amount proportionally.

9.5. Refund

In the event of withdrawal, L'Atelier des J shall refund the customer the entirety of the sums paid, including the initial delivery fees (except for additional fees if the customer chose a more expensive delivery method than the standard one), within 14 days from receipt of the returned products or from proof of dispatch of these products.

The refund is made using the same payment method as the one used for the initial order, unless expressly agreed otherwise by the customer.

11. Claims and Deadlines

Any claim relating to an apparent defect, a delivery error (missing product, product different from the order) or a damaged product must be notified to L'Atelier des J within 7 days following receipt, by email to contact@l-atelier-des-j.fr, accompanied by:

  • Clear photographs of the product and the packaging
  • A precise description of the problem
  • The order number

After this period, claims for apparent defects shall no longer be admissible, without prejudice to the application of the statutory warranties.

12. Statutory Warranties

All products sold by L'Atelier des J benefit from the statutory warranties provided for by the French Consumer Code and the French Civil Code.

STATUTORY WARRANTY OF CONFORMITY

The consumer has a period of two (2) years from delivery of the goods to obtain the implementation of the statutory warranty of conformity in the event of a defect of conformity. During this period, the consumer only needs to establish the existence of the defect of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period exceeding two years, the statutory warranty applies to that digital content or digital service throughout the planned supply period.

The statutory warranty of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The statutory warranty of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer requests repair of the goods, but the seller imposes replacement, the statutory warranty of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

  • The professional refuses to repair or replace the goods;
  • The repair or replacement of the goods takes place after a period of thirty days;
  • The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or where they bear the costs of installation of the repaired or replacement goods;
  • The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the defect of conformity is so serious that it justifies immediate price reduction or termination. The consumer is not then required to first request the repair or replacement of the goods.

The consumer is not entitled to terminate the sale if the defect of conformity is minor.

Any period of immobilisation of the goods for the purpose of repair or replacement suspends the warranty that remained to run until the delivery of the restored goods.

The rights mentioned above result from the application of articles L217-1 to L217-32 of the French Consumer Code.

A seller who, in bad faith, obstructs the implementation of the statutory warranty of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of the average annual turnover (article L241-5 of the French Consumer Code).

The consumer also benefits from the statutory warranty against hidden defects pursuant to articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

Implementation of the warranties: To enforce their rights under the statutory warranties, the customer must contact L'Atelier des J by email at contact@l-atelier-des-j.fr specifying the nature of the defect observed and attaching photographs if necessary.

13. Limitation of Liability

The liability of L'Atelier des J cannot be engaged in the following cases:

  • Non-compliance by the customer with these Terms
  • Non-compliant use, misuse or modification of the products by the customer
  • Normal wear and tear of the products
  • Unforeseeable and insurmountable acts of a third party to the contract
  • Event constituting force majeure

The liability of L'Atelier des J may in no event be engaged for indirect damages, such as loss of profit, loss of opportunity, commercial or financial harm, resulting from the purchase or use of the products.

In any event, should the liability of L'Atelier des J be retained, the total amount of damages payable may not exceed the amount of the order concerned.

The above limitations of liability do not apply in the event of wilful misconduct, gross negligence, bodily injury or breaches of the essential obligations of the contract.

14. Force Majeure

L'Atelier des J cannot be held responsible for the total or partial non-performance of its obligations if such non-performance is caused by an event constituting force majeure within the meaning of article 1218 of the French Civil Code, notably:

  • Natural disasters, fires, floods, storms
  • Pandemics, epidemics, health crises
  • Wars, acts of terrorism, riots, civil unrest
  • Strikes, labour movements affecting transport or production
  • Shortage of raw materials or components
  • Failure of suppliers or subcontractors
  • Major technical failures, cyberattacks
  • Governmental or regulatory decisions impacting the business

In the event of force majeure, the obligations of L'Atelier des J are suspended for the duration of the event. If the event lasts more than 30 days, either party may terminate the order without indemnity, and the customer shall be refunded the sums paid.

15. Intellectual Property

All elements of the website https://l-atelier-des-j.fr, including texts, photographs, images, logos, designs, 3D models, and source code, are the exclusive property of L'Atelier des J or of their respective authors and are protected by intellectual property laws.

Any reproduction, representation, modification, publication, adaptation, in whole or in part, of these elements, by any means whatsoever, without the prior written authorisation of L'Atelier des J, is strictly prohibited and constitutes an infringement punishable under articles L335-2 et seq. of the French Intellectual Property Code.

16. Protection of Personal Data

Purposes of processing: The personal data collected is necessary for:

  • Order management and processing
  • Product delivery
  • Customer relations management and after-sales service
  • Sending of commercial communications (with consent)
  • Management of the loyalty and referral programme
  • Compliance with legal and regulatory obligations

Legal basis: Performance of the contract, consent (for newsletters), legal obligations.

Recipients of the data: The data may be transmitted to subcontractors necessary for the performance of the orders (carriers, payment providers, host). It is never sold to third parties.

Retention period:

  • Customer data: 3 years after the last order
  • Accounting documents: 10 years (legal obligation)
  • Prospecting data: 3 years from the last contact

Rights of individuals: In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, you have the following rights:

  • Right of access to your data
  • Right of rectification
  • Right to erasure ("right to be forgotten")
  • Right to restriction of processing
  • Right to data portability
  • Right to object
  • Right to define directives concerning the fate of your data after your death

16 bis. Data specific to personalised products: For the manufacture of personalised products (named patch, personalised rank plate, support including a name, a first name, a professional registration number — in particular RIO —, a unit or service of assignment, an individual rank, a photograph or any other identification element), the buyer voluntarily provides the data necessary for this personalisation. L'Atelier des J undertakes to:

  • process this data exclusively for the purposes of production and delivery of the goods ordered, as well as any associated after-sales service;
  • delete the production files (CAD files, print files, intermediate visuals) containing this data within a maximum period of ninety (90) days from delivery, unless the buyer expressly requests retention for the purposes of reprinting, in which case the retention period is extended to a maximum of two (2) years;
  • never reuse or disseminate personalised visuals (in particular on marketing materials, social networks, website, commercial communications or portfolio) without the written, express and prior consent of the buyer, formalised separately from the acceptance of these Terms;
  • take reasonable technical and organisational measures, having regard to the particular sensitivity of the identifying data of law enforcement and security professionals, to prevent any unauthorised access.

The buyer is solely responsible for the accuracy of the data provided and for the legitimacy of its use, in particular when it concerns data relating to a third party (order placed on behalf of a colleague, as a gift, etc.); in this latter case, the buyer guarantees having previously obtained the informed consent of the person concerned.

17. Evidence and Archiving

The computerised records kept in the IT systems of L'Atelier des J and its partners (host, payment providers) shall be considered as evidence of the communications, orders and payments made between the parties.

In accordance with article L213-1 of the French Consumer Code, contracts concluded electronically for an amount exceeding 120 euros are archived for a period of 10 years. The customer may access them on request from customer service.

These records are kept on reliable and durable media and constitute faithful copies within the meaning of article 1379 of the French Civil Code.

18. Applicable Law and Dispute Resolution

These Terms are governed by French law.

Amicable settlement: In the event of a dispute, the customer is invited to first contact the customer service of L'Atelier des J at contact@l-atelier-des-j.fr in order to seek an amicable solution.

Consumer mediation: In accordance with articles L611-1 et seq. of the French Consumer Code, the consumer customer has the right to free recourse to a consumer mediator with a view to the amicable resolution of a dispute.

Online dispute resolution platform: In accordance with European Regulation No 524/2013, the customer may also use the Online Dispute Resolution (ODR) platform of the European Commission, accessible at: https://ec.europa.eu/consumers/odr

Competent jurisdiction: Failing amicable resolution or mediation, the dispute shall be brought before the competent courts. Consumer customers may, at their option, refer the matter to one of the courts having territorial jurisdiction under the French Code of Civil Procedure, or to the court of the place where they resided at the time of the conclusion of the contract or of the occurrence of the harmful event, in accordance with article R631-3 of the French Consumer Code.

19. Miscellaneous Provisions

Partial nullity: If any of the provisions of these Terms is declared null or unenforceable pursuant to a law, a regulation or following a court decision having become final, it shall be deemed unwritten, but the other provisions shall retain their full force and scope.

Non-waiver: The fact that L'Atelier des J does not avail itself, at a given moment, of any clause of these Terms cannot constitute a waiver of its right to subsequently avail itself of the same clauses.

Entire agreement: These Terms and the order summary constitute the entire agreement between the parties and supersede any prior agreement or proposal.

20. Loyalty and Referral Programme

20.1. Loyalty Programme

L'Atelier des J offers its customers a loyalty programme allowing them to obtain rewards on their purchases on the website https://l-atelier-des-j.fr.

Each validated order generates a reward equivalent to 5 % of the total amount spent (excluding taxes and shipping fees).

Rewards are automatically credited to the customer account and may be converted into vouchers from a minimum cumulative amount of 5 €. Rewards are valid for one (1) year from their date of issue. Vouchers may only be used on the website, within their period of validity. Vouchers cannot be exchanged for cash or transferred to a third party.

L'Atelier des J reserves the right to modify, suspend or discontinue the loyalty programme at any time, without indemnity or compensation, while ensuring the retention of rewards already acquired at the date of modification.

20.2. Referral Programme

The referral programme allows any customer having made at least 15 € in validated purchases (excluding shipping fees) to invite their relatives to discover L'Atelier des J.

  • The referred customer benefits from a 5 % discount code valid for 30 days on their first order.
  • The referrer receives a reward equivalent to 5 % of the pre-tax amount of the referred customer's order, credited to their account after validation of the order.

Each customer may refer up to a maximum of 10 referrals. The programme applies only to the first level of referral (direct referrals). Promotional products are excluded from the calculation of rewards.

Invitations are sent via the website, in the name of the referrer. The email addresses of the referrals are used exclusively for the sending of this invitation and are not retained or used for any other purpose.

L'Atelier des J reserves the right to suspend or delete an account in the event of manifest abuse (multiplication of fictitious email addresses, circular referrals, etc.).

20.3. Liability relating to the programmes

L'Atelier des J cannot be held responsible in the event of temporary malfunction of the reward accumulation system or the sending of invitations, provided that such malfunctions do not result from wilful misconduct or gross negligence.

21. Sales via Third-Party Platforms (Marketplaces)

Part of the catalogue of L'Atelier des J may be offered for sale on third-party platforms, in particular Vinted, as well as on social networks (Instagram). These sales are governed primarily by the general terms and conditions specific to the platform concerned, which apply to the buyer in their dealings with that platform (payment, buyer protection, dispute management, right of withdrawal specific to the platform where applicable).

These Terms nevertheless remain enforceable against the buyer, on a supplementary basis, for all matters concerning the nature of the product, its intended purpose, its technical characteristics, the legal qualification of the accessories (article 3 and article 15.2), the framework for their lawful use, and the protection of personal data relating to any personalisations (articles 16 and 16 bis), as soon as the buyer takes delivery of a product designed and manufactured by L'Atelier des J.

The buyer is invited to consult these Terms in their entirety, accessible at any time on the website https://l-atelier-des-j.fr, prior to acquiring any L'Atelier des J product via a third-party marketplace.
