L'Atelier des J benefits from the VAT exemption scheme, in accordance with Article 293 B of the French General Tax Code. Therefore, VAT is not applicable.

2. Scope and Acceptance of Terms

These Terms and Conditions of Sale apply to all orders placed on the website https://l-atelier-des-j.fr, and govern the contractual relationship between Jonathan VARELA, operating under the name L'Atelier des J, and any customer, whether individual (consumer) or professional.

Any order placed on the website implies prior, express, and unreserved acceptance of these Terms and Conditions. The customer acknowledges having read these Terms and Conditions before placing an order.

Modification of Terms: L'Atelier des J reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of order validation by the customer.

3. Products

The products offered on the website are tactical accessories designed to meet the specific needs of law enforcement, field professionals, and private individuals.

Manufacturing:

  • 3D printed products are designed and manufactured in Charente-Maritime in our workshop.
  • Some components (e.g., reflective strips, LED lights, screws) are not manufactured in France but are selected for their durability and compatibility with tactical equipment.

Images and descriptions: Product photographs and descriptions are provided for informational purposes only. Colors and dimensions may vary slightly due to differences in the manufacturing process, materials used, and customer screen display settings. These minor variations shall not constitute a defect of conformity.

Product use: Products sold are intended for use in accordance with their description. The use of tactical accessories is the sole responsibility of the buyer. The customer is required to ensure compliance with current regulations applicable to the possession, carrying and use of these products in their country of residence or use. L'Atelier des J disclaims all responsibility in the event of non-compliant, unlawful or inappropriate use of products sold.

4. Prices

Prices displayed on the website are expressed in euros (€) and are exclusive of taxes (VAT not applicable – Article 293 B of the French General Tax Code).

Prices may be modified at any time by L'Atelier des J. However, products are invoiced based on the rates in effect at the time of order validation.

Shipping costs:

  • Metropolitan France: Shipping costs are calculated according to the chosen carrier (Colissimo or Mondial Relay) and specified before order validation.
  • International: Additional fees may apply depending on the destination and selected carrier.

The total order amount, including shipping costs, is displayed and validated by the customer before final order confirmation.

5. Order and Validation Process

The customer can correct any input errors at each step of the order process before final validation.

Accepted payment methods:

  • Credit card (Visa, Mastercard)
  • PayPal
  • Apple Pay / Google Pay (subject to availability)
  • Local payment solutions adapted to certain countries

Order confirmation: A confirmation email summarizing the essential elements of the order is sent to the customer after payment validation. The customer is advised to keep this email.

Customer responsibility: The customer is responsible for verifying their order before validation. L'Atelier des J declines all responsibility in case of input errors regarding the delivery address or product characteristics ordered by the customer.

Product unavailability: In case of out-of-stock or temporary unavailability after order validation, L'Atelier des J commits to informing the customer as soon as possible and offering:

  • Replacement with an equivalent product
  • Full refund if no alternative suits the customer, processed within 14 days from the customer's request, in accordance with Article L216-3 of the French Consumer Code

6. Payment Methods and Security

Payments are fully secured through our payment partners (Stripe, PayPal). Customer banking data is never stored on our servers.

No cash or check payments are accepted.

The order is validated after payment confirmation by our payment provider.

7. Retention of Title

L'Atelier des J retains full ownership of products sold until full payment of the price, including principal and accessories. In case of non-payment, L'Atelier des J may claim the return of the products.

8. Delivery and Transfer of Risk

Products are shipped after payment validation, within a preparation time of 24 to 48 business hours.

Estimated delivery times:

  • Metropolitan France: 2 to 4 business days
  • International: 5 to 10 business days (variable depending on destination)

These times are indicative and start from the date of package shipment. In case of delivery delay not exceeding 7 business days beyond the announced deadline, no compensation or cancellation may be required, except in exceptional circumstances.

Carriers: Orders are shipped via Colissimo or Mondial Relay, according to the customer's choice.

Transfer of risk: In accordance with Article L216-4 of the French Consumer Code, the risk of loss or damage to products is transferred to the customer when they, or a third party designated by them, physically takes possession of the goods.

Responsibility in case of lost or damaged package: In case of loss or damage to the package during transport, the customer must report it to L'Atelier des J within 7 days following the expected delivery date (or actual date for damaged packages). L'Atelier des J will initiate procedures with the carrier and offer, as appropriate, product reshipping or refund.

Verification upon receipt: The customer is advised to check the condition of the package and products upon delivery. In case of visibly damaged package, the customer must make precise reservations to the carrier and inform L'Atelier des J within 48 hours, with supporting photos.

9. Right of Withdrawal

9.1. Principle

In accordance with Articles L221-18 and following of the French Consumer Code, the consumer customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to justify reasons or pay penalties.

9.2. Exclusions from the right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • Products made to customer specifications or clearly personalized (specific color choice on request, custom dimensions, personalized engraving, etc.)
  • Products that have been unsealed by the consumer after delivery and cannot be returned for hygiene or health protection reasons

9.3. Exercise procedures

To exercise their right of withdrawal, the customer must notify their decision by email to contact@l-atelier-des-j.fr using the withdrawal form below or any unambiguous statement.

9.4. Return conditions

The customer must return the product(s) within 14 days following notification of their withdrawal. To be accepted, the returned product must:

  • Be in its original packaging, intact
  • Show no signs of use, assembly, or deterioration
  • Be accompanied by all accessories and instructions
  • Be returned in protective packaging suitable for transport

Return costs are the responsibility of the customer.

In case of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the product, L'Atelier des J reserves the right to reduce the refund amount proportionally.

9.5. Refund

In case of withdrawal, L'Atelier des J refunds the customer for all amounts paid, including initial delivery costs (except for additional costs if the customer chose a more expensive delivery method than the standard method), within 14 days from receipt of the returned products or proof of shipment of these products.

The refund is made using the same payment method as that used for the initial order, unless the customer expressly agrees otherwise.

11. Complaints and Deadlines

Any complaint regarding an apparent defect, delivery error (missing product, product different from the order), or damaged product must be notified to L'Atelier des J within 7 days following receipt, by email to contact@l-atelier-des-j.fr, accompanied by:

  • Clear photos of the product and packaging
  • Precise description of the problem
  • Order number

After this deadline, complaints for apparent defects will no longer be accepted, without prejudice to the application of legal guarantees.

12. Legal Guarantees

All products sold by L'Atelier des J benefit from the legal guarantees provided by the French Consumer Code and Civil Code.

LEGAL GUARANTEE OF CONFORMITY

The consumer has a period of two (2) years from delivery of the goods to obtain implementation of the legal guarantee of conformity in case of appearance of a defect of conformity. During this period, the consumer is only required to establish the existence of the defect of conformity and not the date of its appearance.

When the sales contract provides for the supply of digital content or a digital service on a continuous basis for a period exceeding two years, the legal guarantee applies to this digital content or service throughout the planned supply period.

The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty days following their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction of the purchase price by keeping the goods or terminate the contract by obtaining a full refund in exchange for returning the goods, if:

  • The professional refuses to repair or replace the goods;
  • The repair or replacement of the goods occurs after a period of thirty days;
  • The repair or replacement of the goods causes a major inconvenience to the consumer, particularly when the consumer permanently bears the costs of collection or removal of the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods;
  • The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract when the defect of conformity is so serious that it justifies an immediate price reduction or contract termination. The consumer is then not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to terminate the sale if the defect of conformity is minor.

Any period of immobilization of the goods for repair or replacement suspends the remaining guarantee until delivery of the goods restored to condition.

The rights mentioned above result from the application of Articles L217-1 to L217-32 of the French Consumer Code.

A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles them to a price reduction if the goods are kept or a full refund in exchange for returning the goods.

Implementation of guarantees: To assert their rights under legal guarantees, the customer must contact L'Atelier des J by email at contact@l-atelier-des-j.fr specifying the nature of the defect found and attaching photos if necessary.

13. Limitation of Liability

L'Atelier des J shall not be held liable in the following cases:

  • Non-compliance by the customer with these Terms and Conditions
  • Non-conforming use, misuse, or modification of products by the customer
  • Normal wear and tear of products
  • Unforeseeable and insurmountable act of a third party to the contract
  • Event constituting force majeure

L'Atelier des J shall in no case be held liable for indirect damages, such as loss of profit, loss of opportunity, commercial or financial loss, resulting from the purchase or use of products.

In any event, should L'Atelier des J be held liable, the total amount of damages due shall not exceed the amount of the order concerned.

The above limitations of liability do not apply in case of fraud, gross negligence, personal injury, or violations of essential contractual obligations.

14. Force Majeure

L'Atelier des J shall not be held responsible for total or partial non-performance of its obligations if such non-performance is caused by an event constituting force majeure within the meaning of Article 1218 of the French Civil Code, including:

  • Natural disasters, fires, floods, storms
  • Pandemics, epidemics, health crises
  • Wars, acts of terrorism, riots, civil unrest
  • Strikes, social movements affecting transport or production
  • Shortage of raw materials or components
  • Failure of suppliers or subcontractors
  • Major technical failures, cyberattacks
  • Government or regulatory decisions impacting the activity

In case of force majeure, L'Atelier des J's obligations are suspended for the duration of the event. If the event lasts more than 30 days, either party may terminate the order without compensation, and the customer will be refunded for amounts paid.

15. Intellectual Property

All elements of the website https://l-atelier-des-j.fr, including texts, photographs, images, logos, designs, 3D models, and source code, are the exclusive property of L'Atelier des J or their respective authors and are protected by intellectual property laws.

Any reproduction, representation, modification, publication, adaptation, in whole or in part, of these elements, by any means whatsoever, without the prior written authorization of L'Atelier des J, is strictly prohibited and constitutes infringement punishable under Articles L335-2 and following of the French Intellectual Property Code.

16. Personal Data Protection

Purposes of processing: Personal data collected is necessary for:

  • Order management and processing
  • Product delivery
  • Customer relationship management and after-sales service
  • Sending commercial communications (with consent)
  • Managing the loyalty and referral program

Legal basis: Contract performance, consent (for newsletters), legal obligations.

Data recipients: Data may be transmitted to subcontractors necessary for order execution (carriers, payment providers, host). They are never sold to third parties.

17. Evidence and Archiving

Computerized records kept in the computer systems of L'Atelier des J and its partners (host, payment providers) will be considered as proof of communications, orders, and payments between the parties.

In accordance with Article L213-1 of the French Consumer Code, contracts concluded electronically for an amount exceeding 120 euros are archived for a period of 10 years. The customer may access them on request from customer service.

These records are kept on reliable and durable media and constitute faithful copies within the meaning of Article 1379 of the French Civil Code.

18. Applicable Law and Dispute Resolution

These Terms and Conditions are governed by French law.

Amicable settlement: In case of dispute, the customer is invited to first contact L'Atelier des J customer service at contact@l-atelier-des-j.fr to seek an amicable solution.

Consumer mediation: In accordance with Articles L611-1 and following of the French Consumer Code, the consumer customer has the right to free recourse to a consumer mediator for amicable resolution of a dispute.

Online dispute resolution platform: In accordance with European Regulation No. 524/2013, the customer may also use the European Commission's Online Dispute Resolution (ODR) platform accessible at: https://ec.europa.eu/consumers/odr

Competent jurisdiction: Failing amicable resolution or mediation, the dispute will be brought before the competent courts. For consumer customers, they may choose to bring the matter before one of the territorially competent courts under the French Code of Civil Procedure or the court of the place where they resided at the time of contract conclusion or occurrence of the harmful event, in accordance with Article R631-3 of the French Consumer Code.

19. Miscellaneous Provisions

Partial nullity: If any provision of these Terms and Conditions is declared null or unenforceable under a law, regulation, or following a final court decision, it shall be deemed unwritten, but the other provisions shall retain their full force and effect.

Non-waiver: The failure of L'Atelier des J to exercise any of the clauses of these Terms and Conditions at any given time shall not constitute a waiver of the right to exercise such clauses subsequently.

Entirety: These Terms and Conditions and the order summary constitute the entire agreement between the parties and replace any prior agreement or proposal.

20. Loyalty and Referral Program

20.1. Loyalty Program

L'Atelier des J offers its customers a loyalty program allowing them to earn rewards on their purchases on the website https://l-atelier-des-j.fr.

Each validated order generates a reward equivalent to 5% of the total amount spent (excluding taxes and shipping costs).

Rewards are automatically credited to the customer account and can be converted into vouchers from a minimum accumulation of €5. Rewards are valid for one (1) year from their issue date. Vouchers are usable only on the website, within their validity period. Vouchers cannot be exchanged for money or transferred to a third party.

L'Atelier des J reserves the right to modify, suspend, or terminate the loyalty program at any time, without compensation, while guaranteeing the preservation of rewards already acquired at the date of modification.

20.2. Referral Program

The referral program allows any customer who has made at least €15 in validated purchases (excluding shipping costs) to invite their friends and family to discover L'Atelier des J.

  • The referee receives a 5% discount code valid for 30 days on their first order.
  • The referrer receives a reward equivalent to 5% of the net amount of the referee's order, credited to their account after order validation.

Each customer can refer up to 10 referees maximum. The program applies only to the first level of referral (direct referees). Products on promotion are excluded from reward calculation.

Invitations are sent through the website, on behalf of the referrer. Referee email addresses are used exclusively for sending this invitation and are not retained or used for other purposes.

L'Atelier des J reserves the right to suspend or delete an account in case of obvious abuse (multiplication of fictitious email addresses, cross-referrals, etc.).

20.3. Liability Related to Programs

L'Atelier des J shall not be held liable in case of temporary malfunction of the reward accumulation system or invitation sending, provided that such malfunctions do not result from willful misconduct or gross negligence.
