3. Products

The products offered on the website are tactical accessories designed to meet the specific needs of law enforcement personnel, field professionals and private individuals.

Manufacturing:

  • The 3D-printed products are designed and manufactured in Charente-Maritime, France, in our workshop.
  • Some components (e.g. reflective strips, LED lights, fasteners) are not manufactured in France but are selected for their robustness and compatibility with tactical equipment.

Images and descriptions: Product photographs and descriptions are provided for information only. Colours and dimensions may slightly vary due to differences in the manufacturing process, the materials used and the customer's display settings. Such minor variations do not constitute a defect of conformity.

Use of the products: The products sold are intended for use consistent with their description. The use of tactical accessories is the sole responsibility of the buyer. The customer is required to ensure compliance with the regulations in force regarding the possession, carrying and use of these products in their country of residence or use. L'Atelier des J disclaims any liability in the event of non-compliant, unlawful or inappropriate use of the products sold.

4. Prices

The prices shown on the website are expressed in euros (€) and are exclusive of tax (VAT not applicable – Article 293 B of the French General Tax Code).

Prices may be modified at any time by L'Atelier des J. However, products are invoiced on the basis of the rates in force at the time the order is validated.

Shipping fees:

  • Metropolitan France: shipping fees are calculated according to the carrier chosen (Colissimo or Mondial Relay) and stated before the order is validated.

8. Delivery and transfer of risk

Products are shipped after payment validation, within a preparation time of 1 to 4 business days.

Estimated delivery times:

  • Metropolitan France: 2 to 4 business days
  • International: 5 to 10 business days (variable depending on the destination)

These times are provided for information only and run from the shipment of the parcel. In the event of a delivery delay not exceeding 7 business days beyond the stated time, no compensation or cancellation may be claimed, save in exceptional circumstances.

Carriers: Orders are shipped via Colissimo or Mondial Relay, depending on the customer's choice.

Transfer of risk: In accordance with Article L216-4 of the French Consumer Code, the risk of loss of or damage to the products is transferred to the customer at the time when they, or a third party designated by them, take physical possession of the goods.

Liability for lost or damaged parcels: In the event of loss of or damage to the parcel during transport, the customer must report it to L'Atelier des J within 7 days of the scheduled delivery date (or actual delivery date for damaged parcels). L'Atelier des J will take the necessary steps with the carrier and, depending on the case, offer a re-shipment of the product or a refund.

Inspection on receipt: The customer is invited to check the condition of the parcel and the products upon delivery. In the event of a visibly damaged parcel, the customer must issue precise reservations with the carrier and inform L'Atelier des J within 48 hours, with photographs to support the claim.

Parcel returned to sender for reasons attributable to the customer: When a parcel is returned to L'Atelier des J for any of the following reasons, attributable to the customer:

  • incorrect, incomplete or out-of-date address;
  • lack of access to the address or inability to identify the mailbox;
  • recipient unknown at the indicated address;
  • parcel not collected at the pickup point or post office before expiry of the holding period;
  • refusal of the parcel by the recipient without legitimate reason,

the re-shipment fees are entirely borne by the customer. A flat handling fee of €2 is additionally applied to cover the handling of the return. The customer may then choose:

  • re-shipment of the parcel to the corrected address, after payment of the new shipping fees and the handling fee;
  • cancellation of the order; in that case, the price of the products is refunded, less the €2 handling fee and the initial shipping fees, which remain acquired by L'Atelier des J in consideration of the shipment actually performed.

Legitimate grounds for refusal notably include: a parcel visibly damaged on receipt, or a product error observable from the outside. This clause does not apply to the exercise of the right of withdrawal provided for in Article 9 below, which must be subject to an express notification, nor to returns resulting from an error attributable to L'Atelier des J or to the carrier.

9. Right of withdrawal

9.1. Principle

In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay any penalties.

9.2. Exclusions from the right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • Products made to the consumer's specifications or clearly personalised (specific colour on request, custom dimensions, personalised engraving, etc.)
  • Products that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection

9.3. How to exercise the right

To exercise the right of withdrawal, the customer must notify their decision by email to contact@l-atelier-des-j.fr using the withdrawal form below or any unambiguous statement.

9.4. Return conditions

The customer must return the product(s) within 14 days of notifying their withdrawal. To be accepted, the returned product must:

  • Be in its original, intact packaging
  • Show no trace of use, assembly or damage
  • Be accompanied by all accessories and instructions
  • Be returned in protective packaging suitable for transport

Return shipping costs are at the customer's expense.

In the event of depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product, L'Atelier des J reserves the right to reduce the refund amount proportionately.

9.5. Refund

In the event of withdrawal, L'Atelier des J shall refund the customer the total amount paid, including the initial delivery costs (except for additional costs if the customer has chosen a more expensive delivery method than the standard one), within 14 days of receipt of the returned products or of proof of shipment of these products.

The refund is made using the same means of payment as the one used for the initial order, unless the customer expressly agrees otherwise.

11. Claims and time limits

Any claim concerning an apparent defect, a delivery error (missing product, product different from the order) or a damaged product must be notified to L'Atelier des J within 7 days of receipt, by email to contact@l-atelier-des-j.fr, accompanied by:

  • Clear photographs of the product and the packaging
  • A precise description of the issue
  • The order number

After this period, claims for apparent defects will no longer be admissible, without prejudice to the application of the legal warranties.

12. Legal warranties

All products sold by L'Atelier des J benefit from the legal warranties provided for in the French Consumer Code and the French Civil Code.

LEGAL WARRANTY OF CONFORMITY

The consumer has a period of two (2) years from delivery of the goods to obtain the implementation of the legal warranty of conformity in the event of the appearance of a defect of conformity. During this period, the consumer is only required to establish the existence of the defect of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period exceeding two years, the legal warranty applies to that digital content or digital service throughout the supply period provided for.

The legal warranty of conformity entails, for the trader, the obligation, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal warranty of conformity gives the consumer the right to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer requests repair of the goods but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract with a full refund against return of the goods, if:

  • The trader refuses to repair or replace the goods;
  • The repair or replacement of the goods takes place after a period of thirty days;
  • The repair or replacement of the goods causes a major inconvenience to the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the installation costs of the repaired or replacement goods;
  • The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the defect of conformity is so serious that it justifies an immediate price reduction or rescission of the contract. The consumer is then not required to first request repair or replacement of the goods.

The consumer is not entitled to rescission of the sale if the defect of conformity is minor.

Any period during which the goods are out of service for repair or replacement suspends the warranty that remained to run until the delivery of the repaired goods.

The rights mentioned above arise from the application of Articles L217-1 to L217-32 of the French Consumer Code.

A seller who, in bad faith, obstructs the implementation of the legal warranty of conformity incurs a civil fine of up to €300,000, which may be increased up to 10% of the average annual turnover (Article L241-5 of the French Consumer Code).

The consumer also benefits from the legal warranty for hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

Implementation of the warranties: To assert their rights under the legal warranties, the customer must contact L'Atelier des J by email at contact@l-atelier-des-j.fr, specifying the nature of the defect observed and attaching photographs if necessary.

13. Limitation of liability

L'Atelier des J shall not be held liable in the following cases:

  • Failure by the customer to comply with these Terms
  • Non-compliant use, misuse or modification of the products by the customer
  • Normal wear and tear of the products
  • Unforeseeable and insurmountable act of a third party to the contract
  • Event constituting force majeure

L'Atelier des J shall in no event be held liable for indirect damages, such as loss of profit, loss of opportunity, commercial or financial loss, resulting from the purchase or use of the products.

In any event, should the liability of L'Atelier des J be retained, the total amount of damages due shall not exceed the amount of the relevant order.

The limitations of liability above do not apply in the event of wilful misconduct, gross negligence, bodily injury or breaches of the essential obligations of the contract.

14. Force majeure

L'Atelier des J shall not be held liable for the total or partial non-performance of its obligations if such non-performance is caused by an event constituting force majeure within the meaning of Article 1218 of the French Civil Code, in particular:

  • Natural disasters, fires, floods, storms
  • Pandemics, epidemics, health crises
  • Wars, acts of terrorism, riots, civil unrest
  • Strikes, social movements affecting transport or production
  • Shortage of raw materials or components
  • Failure of suppliers or subcontractors
  • Major technical failures, cyberattacks
  • Governmental or regulatory decisions affecting the business

In the event of force majeure, the obligations of L'Atelier des J are suspended for the duration of the event. If the event persists for more than 30 days, either party may terminate the order without compensation, and the customer shall be refunded the amounts paid.
